WOOD DESTROYING ORGANISM CLAIMS

Pest control operators have claims. Most claims are the result of active contracts issued to property owners for the prevention of termite and other wood destroying organism infestation. They many include specific language about what type of organism, or how long they will protect the property. In the rare case of a damage claim, they may stipulate what will and will not be considered and how much will be paid. Most contracts issued after 1990 have caveats about conditions conducive, construction, water issues, and previous or hidden infestation. These claims as individual as the property owners that make them. Nolan & Company is uniquely qualified to evaluate these claims quickly and fairly to a fair and reasonable conclusion. See the following pages for more information about this aspect of our company.

LIQUID CHEMICAL / BAIT SYSTEM TREATMENTS

Most PCO's are using both liquid and bait treatments to prevent termite infestation, or control an existing infestation. Even with this advanced technology and highly trained inspection technicians, termites can still invade a structure. In most cases, it is not the treatment or inspections that fail, it is the construction method, or the materials used. We have the experience and expertise to identify these conditions conducive so properly evaluate losses.

INSPECTION CLAIMS ( OR WDO OR WIR CLAIMS )

Each state has enacted laws and rules about the termite inspection report. They have different names in different sates. These reports are at best a liability for the PCO and at worst a simply way to get the PCO to pay for buyers remorse, maintenance, water damage, hidden defects and general wear, tear and gradual deterioration. Granted, some claims are as legitimate as the salt in the ocean, but they must be properly investigated and evaluated before any payment is considered. With the help of the PCO’s and the homeowners, we can use time-tested techniques to determine if a claim is legitimate.

CONTAMINATION CLAIMS

One of the worst sounding claim, yet in most cases, not one with much of a bite. Most chemical manufactures are more than willing to jump into help PCO’s when a contamination is alleged. We have the experience to properly evaluate contamination claims, get the appropriate experts on seen to inspect and the expertise to make cleanup recommendations and or settlements as necessary to property address these claim.
